This standard is met where an employer has cost data which show the actual cost to it of providing the particular benefit or benefits in question over a representative period of years.
Even if an employer's costs increase based on a factor correlated with age, however, the Supreme Court has made clear that this is insufficient to show that the cost increases are in fact age- based.
